General terms

General Conditions – BodyBoxEurope

Underneath are our general conditions. These are, together with the references they inhabit, are applicable on every agreement which we, BodyBoxEurope ( with Camber de Commerce number  66429870 ) and BTW number (NL856549587B01), enter into with you. When you have any questions, do not be afraid to contact us trough info@bodyboxeurope.com or with post : BodyBoxEurope, Beek 6, 5815CS, Merselo, The Netherlands. We have to right to change these general conditions. You agree with it that every time the latest version of these general conditions will be applicable on our agreement.

Article 1 – Products

We sell the Bodybox, a box full with articles around fitness.

Article 2 – Registration

You need to register to be able to purchase a product. You need to give your personal data to be able for us to register you. These personal data need to be filled in honest and correct and need to be up to date. We will protect your personal data : please also read our Private Statement on our website. Use  a strong password for your account en never ever give your password to other persons! You are responsible for misuse of your password ( example : when another person logs in with your password and places an order with us ).

Article 3 – Payments

The (total) price of our products is mentioned in our web shop. You pay in advance via our online payment service . Mollie B.V. takes care of this payment service. The transport costs need to be paid by the customer

Article 4 – Deliveries

We will deliver your package to the address that you mentioned when ordering the product. You cannot change the address ones we have send the package. DHL Parcel will take care of delivering the package. When the package has been send, you will get a track & trace code from us, with which you can follow the package. We are doing our upmost best to deliver the package as soon as possible. We will let you know in writing when the delivery is delayed .We guarantee that your  package will be delivered within 30 days after confirmation of the order.  Should this not be possible  than you can ask usu to (a) return the amount of the order immediately , or (b) to send a replacing product ( of equal value).

 

Article 5 – Return

You are allowed to return the product, once received, back within 14 days. You can do this with the return-form or by sending an email to info@bodyboxeurope.com. After you have received an confirmation from us, you need to send it back within 14 days. If we have received the product, we will refund the full purchase amount . The cost for the return will be on your account. You need to handle the product and package with care and that the product is not damaged at all in case you would like to send it back. You are only to unpack the product and use the product as far as necessary to determine whether  to want to keep the product.

Article 6 – Liability

We are not responsible for the damage which is caused by using this product in any form. This does not apply when the damage is due to our design, gross negligence or willful recklessness. Your right for compensation will be in any case a maximum of the ordered and paid product.

Article 7 – Intellectual Property ( IP )

All IP rights ( such as : royalty, logos, word marks ) on our texts, picture, images and other materials, are our property ( or we manage it with authorisation of the rightful claimant ). Your use may not infringe this.

Article 8 – Complaints

When you have an complaint concerning the execution of the agreement, will would like to know it. Send your complaints asap ( and as clearly as possible written down) to info@bodyboxeurope.com.  We will settle your complaint asap, not later than 5 days after we have received your complaint. When it would take longer to settle your complaint, you will receive a confirmation of your complaint within 2 days after we have received it, and we let you know when we expect to give you a answer. When we cannot solve the complain together, a dispute arises which falls within the dispute commission.

Article 9 –  Dispute

The Dutch Federal Law is applicable on these general conditions and the agreements which we arrange with each other.  In case of a dispute the Court in Limburg, The Netherlands, is competent.
